Ask a KKC Attorney

Attorney Allison Poirier

Question:

How does an estate get distributed if a beneficiary dies before the estate is settled?

Answer:

If a beneficiary of an estate dies before the estate is settled, any assets the beneficiary was entitled to receive will pass instead to the beneficiary’s estate. Once the assets are received by the deceased beneficiary’s executor (and once the deceased beneficiary’s estate is settled), the executor will distribute the assets to the individuals named in the deceased beneficiary’s Will and/or Trust.
